Hi people, I am currently applying change of status from H1 to F1. Since my PERM got audit, and my h1 visa is going to expire in the end of January 2009, I need to change my status to F1 student visa in order to stay in the U.S legally. Now, I am trying to fill out the form I-539 by myself, and I got confused on:
part 4. additional information on 3g:"Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status?"
I don't know should I put "YES" or "NO", I have never done "i-539 for change of status" on my first F1/OPT to H1 visa....but I actually worked in the U.S...
Can anyone help me to answer that? Thanks a lot!!!

I am a software consultant on H1B. I have recently concluded my employment in California for client A and now I have relocated to GA where I am working for client B.
I have the following questions in this regard:
1) Should I do an LCA transfer to the state of GA from CA? + How many days do I have from the date of original relocation to do this transfer?
2) Can I do this paper work by myself or would I need the help of an immigration lawyer? + Any idea of what the average / approximate expense would be?
Any information with regards to this is highly appreciated.

You are paroled into US until Dec 05, 2009. But if you want to travel outside US after July 29, you better apply for AP now.

Both me and my wife are on EAD and have valid AP (valid till December 2010), H1 expires in Jan 2011(not stamped on our passport) . Priority date is June 2005, have a job and have current paustubs/w2.
My wife is in India currently - we both are planning on coming back in April sometime with our new born baby. My question is about getting H4 stamped for our baby.
1.Do we need to get our H1 stamped on our passport to get H4 for our kid ?
2.What happens if our I485 gets approved before we get H4 stamp for our kid ?
3.What is the procedure these days to get H4 stamped on passport ?

1. Yes, H4 is derivative status. Primary should be in H1 status.
2. As long as kid was born BEFORE I-485 was approved, kid can get GC as follow-to-join.
3. Contact the US consulate in your area and your employer to get list of documents needed.

You should be glad it says 2006, check out Texas I-140, it's now back to August 01, 2003 for EB3!!
I kept checking for the processing times for I-140 for my wife on the following link https://egov.uscis.gov/cris/jsps/ptimes.jsp under the Nebraska center. Till yesterday the post date was showing May 18th and the processing time for I-140 was shown as 'September 2006' today the posted date changed to 15th June but the I-140 processing date went back to 'January 2006'. Can someone explain how is this possible? Shouldnt the processing date mean that applications received till 25th Sept 2006 have been processed? If thats correct then how can the date go back to Jan 1 2006? I dont think this can be a typo, it must have some reasoning. I would appreciate if someone can explain this in the forum
