Sure. You need to work outside the US for the sponsoring company in a managerial capacity for 1 out of the 3 years prior to filing the I140. So if you are on a H1B and are a manager, you can sign up for an assignment abroad to fulfill that requirement.

Hi,
to stay away from india while on AOS, you need AP.
to maintain AOS, one needs to keep renewing AP.
So when you apply/renew AP candidate needs to be here...
So your daughter will apply for AP, get it , travel... come back 6 months prior to AP expiry, go to india and study and you will send AP by mail ...
she will come here every 4-6 months prior to AP expiry and renew and go back.
You need to give a sound reason in port of entry why you are staying away for long durations..!

Once they get your response, it will be added to your case and delivered to the officer who issued the RFE. He/she will then make a decision on your case. If at that time your PD is not current, your case can not be approved even if it is approvable, but will be sent to on hold, waiting for your PD to be current.

I-94 determines your status in US and visa stamp is a merely used to enter into US .hence make sure your I-94 is stamped till the expiry date of new I-797 otherwise you would get into issues.

Hi,
I am in a unique situation, any advise/help would be appreciated.
My H1 Visa and I-94 are expiring on Jan 20, 2009. It can be extended till Apr 2011 as I have been in US only for 3 Yrs and 8 Months. My current employer is not extending my Visa, so I am going to get it extended through another company, say COMPANY ABC (a Staffing company basically).
However, I don't want to be with Company ABC because I am soon going to get a job with a direct client, CLIENT XYZ, but that won't happen until Jan 25th or so.
So my question is, if I apply for extension through COMPANY ABC for now, just so that I don't go 'out of status' on Jan 20th, will CLIENT XYZ be able to apply for my extension on Jan 25th, while my application with Company ABC is still pending? Or they (CLIENT XYZ) will have to wait until my first application (With COMPANY ABC) is processed?
Basically, just want to know if a Company ABC has filed for H1 Transfer and I-94 extension before the expiry date, can another Company XYZ file for an extension/transfer after the expiry while the application from company ABC is still being processed?
Any help is appreciated. I have posted this query on couple of other posts but no one seems to know the answer! no one replied yet :(

My company merged with another one last year just after my I-140 was approved. I'm preparing to file I-485 (doing it myself) and I'm wondering what kind of documents/letters do I need to submit to USCIS to proof that my job wasn't affect by the merger and I'm still working in the same position.
I'd really like to send all required information to USCIS so that I don't have to reply to RFEs later on.
Any examples of letters or list of supporting documents will be appreciated.

For EB3 case, after receiving the approval for I 140, I know that we have to wait till DOL Proiority Date is current to be able to file for I485.
If we decide to receive the green card in any consulars overseas, can we just go ahead and file the I485 after getting the I140 approval? (without waiting for PD to be current):

Not an error. Per law you have 10 days after your H1 expiry to wrap up and leave the country. Some CBP officers add that to the I-94

Hi All,
I recently got my I140 approved and I am waiting to file my I485 as my priority date(Oct 2007) is still not current(EB2 category, India).Not sure how long it is going to take as the current backlog is July 2000 for India and China.
My brother is a citizen of the US and I need to clarify if my brother can apply for a family-based green card for me and how long does it take to get the EAD when applied through this process as compared to filing through the employer when I reach my priority date.
Also need to clarify if this process is sooner or still the same as applying through the employer.
