you can control the camera... just use the same technique as you do with the rest. On the left panel, select the camera option and go to town!

First, I'd like to express my thanks to IV for taking up this cause and doing a wonderful job!
I am currently on an H1-B visa. My 6 year term expires 2/1/09. Current employer is yet to file LCA. Company lawyers have advised that any time I've spent out of the country (past & within next few months) can be used to offset the 1-yr cut off requirement for LCA application. I've been out for a total of 6 weeks to date, but would need more time, looking at an April-end LCA filing. I am now looking to change my job.
-Can I change my status to H4 until I get another job and then file for GC with new employer?
-What are current processing times for H4 if applied from within the US?
-Will I get subjected to H1 quota when changing back from H4 to H1?
-I've been told time spent on H4 is not counted for H1 term and I can apply that time (in addition to my 6 weeks) to the 1-yr limit (LCA should be filed 1 yr before 6-year H1 expiration). Is this true?
-If so, what about the time taken for H4 approval? Can I be in status after resigning & while waiting for H4 approval? Can the time taken for H4 approval be counted towards time not on an H1?

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

My confusion is, as soon as I enter on AP I am on EAD and I don't have approved EAD. Does this mean I can not work untill I get EAD approved? I don't have Visa Stamped and I am not planning for Visa Stamping.
you can still continue on H1B (same employer) as long it is validity..even when you use AP at POE..

Company B applied H1B tranfer petition for me two weeks back. Our documents went to USCIS, and we didnt received receipt notice yet. To my surprise the filing fee check is also not yet encashed.
Can anyone of you please let me know, if I can start working with company B now or wait until we get the receipt notice. What is the USCIS guidelines with the start date during H1B transfer.

Since USCIS started I-140 premium processing service on 06/29/09, you can try and upgrade your pending I-140 to premium processing so you can get a decision on your case within 15 days...When you get your I-140 approval, you can file for a 3 yr H1 extension based on it.

I'm talking about post completion OPT - if you have ur EAD card, u can travel with a valid and current employment letter. When it's pre-completion OPT, u r on F1 anyways so u should get stamping...

HI all,
I would like to have your opinion regarding my spouse visa, I applied for H1B visa in Cairo Egypt. I'm a female IT pro and got the visa with my 2 sons 5-2 years old. My husband was not given visa, VO never asked him any question and just stapled a paper to his passport to track his visa status online. I asked VO wheathre that means my husband was rejected, she said no just some delay, it takes some cases more time.
it has been one month since I did my interview in the consulate and nothing updated on that web site. My husband has his sister in USA with Green card. What do you think the situation will be? is it rejection or wil get visa later?

Hi Everyone
Just wondering if anyone in the forum can help me with this question.
My original EAD applied for in June 12, 2010 was approved on Sep 2, 2010. But, the document was lost in mail and after 90 days I was instructed by USCIS to reapply.
And, I did reapply on Oct 12, 2010 and the case is pending on initial review although I received the I-797 Notice of Action 'Replacement Receipt' on Oct 15, 2010.
According to the I-9 Receipt rule, I can start work for a period of 90 days using the 'replacement receipt' which is just a similar receipt for an I-765 application but for a replacement EAD (lost in mail). This is in the I-9 handbook in the uscis.gov site.
My question is:
According to the 90 day unemployment rule starting April 8, 2008, if we start employment using the I-9 receipt rule, do the days of unemployment still count against the aggregate of 90 days allowed after the OPT start date ?( which in my case is Sep 20, 2010.. I presume because this is the date I had provided on the approved original EAD application which was approved on Sep, 2nd, 2010 and I had lost in the mail).
So, basically in this special case where both the I-9 receipt rule & 90 day unemployment rule apply, what happens with the umemployed days accrued even if i accept employment?

Hello,
I am currently working for a leading retail company in the US. I filed for my 485 in July 2007 and is pending. The retail company acquired my smaller company and as result had to file for 140 again in 2008. In March 2009 my I-140 was approved and I recd. an email that it was approved and the notice was sent.
Since the I-140 is mailed to the employer, I asked them for a copy of the same. Initially they refused saying it is an employer petetion and after I requested again they said they will provide a copy when the receive it.
It is June now and they claim they have still not recd. it. They are saying they will have to request another one and due to budget constraints they are not going to request one as it costs money. Is this true that you have to spend money again to request a copy if you never recd. it? How much does this cost? Without the copy i do not know what priority date is mentioned.
Suppose in future i want to switch jobs, I would like to know if I need to have a copy of 140 if I want to use AC21?
What are my choices as at this point company says that they have the petetion # and they can use that for any purpose and will not request a copy. This seems a little odd to me.

I have a 4 year college degree from the US and 5 years of experience. I would like to know when they say 5 years of progressive experience does also that include an increase in salary over the five years? My previous employer paid me 60kper anum but my new employer is paying me 55k per anum. There is drop in salary by 5 thousand. Will this affect my application. Please advise. Thanks much!
