    This is an awesome community folks. I was able to get enough people to respond to this thread and the NPR reporter was surprised and very happy that we could do this even on a weekend.

    I doubt, it has anything to do with the filing AOS before a certain date. Whatever fee is mentioned on uscis website will apply for everybody.

    Hi,

    I was wondering if there is a limit on the # of travels for each AP approval. I received 2 AP documents valid until May 2010. I have already travelled twice. On my first return the immigration officer kept my AP document at POE (NY) but the 2nd time it was stamped & returned (Washington DC was POE) to me. I was wondering if I could use this document for subsequent re-entries or do I have to apply for a new AP.

    hi, i just got my receipt and fingerprint apointment for the I-485 (mine is a family petition with the I-130 approved) couples of weeks ago(my fingerprint apointment is next week), and yesterday i got a letter with request of evidence that says;


    The Household menber (me) on form 864A, Contract between Sponsor and Household Member provided a different address from the petitioner/sponsor on form 864A, Afiidavit of support an/or is not listed as dependent on the petitioner/sponsor's federal income tax return.
    Please submit evidense that the household member listed on form I-864A, lives at the same address as the petitioner/sponsor or was listed as dependent on the petitioner/sponsor's federal income tar return

    I want to know what can i sent in order to prove that i live in the same house. My stepdad (my peticioner) couldn't put me in his tax because they said he couldn't because i don't have a social security number yet. Do the guy who does our taxes make a letter stating i live there but could'nt be included in the taxes? or should my stepdad do it? or does mail could be consider evidence or a copy of my drivers license with the same address?
    My mom went throught the same, they kept asking her for more evidence but eventually she got all her papers. I wish this could be more easy.

    Sorry to say this but it is totally speculative. It may be It may not be. It may be someone elses I140. You have to think about a way to get it from the employer or USCIS.

    I am not a concurrent filer but i hope people would post their dates for your speculation. Good Luck.

    I am currently employed by a large US-based multinational firm on an H-1B visa. My 6 year limit on H1 expires on Nov 27, 2011.

    My employer filed Labor Certification for my employment-based Green Card (EB2) over a year ago (on March 1st, 2010).

    Since it has been more than a year since Labor has been filed, I am assuming my employer can file for a 1-year extension to my H-1B visa 6 months before it expires (that is on June 27th, 2011). Also, in the meantime, if my Labor and subsequent I-140 are approved, I am assuming my employer can file for 3-year extension to my H-1B.

    Question 1: Are these assumptions above correct?

    Question 2: Can I quit my job and join another firm after the 1 or 3 year extension is granted? That is will another employer be able to file an H1 petition on my behalf for the extended H1 period (that is beyond 6 years) - even though the extension was granted because of a Labor Certification filed by the previous employer?

    I plan to get married to an American Citizen in September. Once I get married, I will obviously file for a marriage-based green card.

    Question 3: Given the above, can I quit my job and join another firm now (before my H1 extension is filed)? What are my risks?

    If I do stay with my current employer - once I get married, I am assuming that I can file for my marriage based green card (form I-130) and adjustment of status (I-485) concurrently.

    Question 4: Is the above assumption correct?

    Question 5: Can I also file for EAD concurrently with my I-485? How soon can I expect to leave my current employer and take up a job based on the EAD / marriage-based green card?

    Appreciate any guidance.

    Acting Associate Director Donald Neufeld has issued revised guidance regarding the
    I-90 Application to Replace Permanent Resident Card. The guidance is dated February 6, 2009.

    Previously, if an I-90 applicant presented a national security concern or had a record of arrest or presented an �Egregious Public Safety� concern, then the USCIS adjudicator was instructed to immediately suspend adjudication of the 1-90 and refer the case to ICE.

    The problem with that position, as pointed out in the Neufeld memo, is that an I-90 applicant who is a Lawful Permanent Resident LPR holds that status until he or she either abandons it themselves or has it revoked through rescission or removal proceedings. Therefore, until the LPR status is either abandoned or revoked, the applicant is entitled to evidence of his or her status.

    Now, the Neufeld memo provides that all 1-90 applications will be adjudicated when all of the basic filing requirements and conditions have been met:

    1. The applicant has established his or her identity; and

    2. It has been established that the applicant is a lawful permanent resident.

    Once those conditions have been met, the I-90 should be approved regardless of whether derogatory information comes up during the fingerprint and IBIS checks. If that happens, the I-90 should still be approved first and the derogatory information issue addressed second, presumable with a referral to ICE.

    In the past, some applicants have been served with Requests for Evidence (RFE) asking for arrest records or court dispositions. Now any RFE that is issued must be limited to requesting supporting documentation related to establishing identity or status.

    Hi,

    My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree

    Do we need to do interview candidates before rejecting?

    My PD is EB2March 2005.
    My position titles are not same though the job is similar.
    My salary is 35% more
    Please advice if it is too risky to file for AC21

    There has been many discussions about AC21. Please search for them and read.

    If you have a job in same/similar you should be OK.

    There is no form or application to fill. Some prefer to inform USCIS but not a requirement.

    With your priority date, why don't you wait for end of this fiscal year to see if your GC gets approved.

    Hi,
    Is it possible to be on H1B after AC21 is invoked?
    Here is my situation-
    I filed I485, EAD and AP in July with approved I140. This month My company is acquired by new company. Starting November 1st I will be employee of new company.
    I just finished conference call with my lawyer as per him, There is no change in GC process only New Company has to file AC21 after 180 days of filing 485. When I asked him whether I can maintain my H1 after filing AC21 he said yes.

    Is it possible?

    Please advise
